Position: Deputy General Counsel 2

Agency: Coastal Protection and Restoration Authority (CPRA)

Division: Executive

Office Location: 150 Terrace Avenue, Baton Rouge, LA

This position serves as the principal assistant to the General Counsel to the Coastal Protection and Restoration Authority (CPRA) and as such, performs highly responsible and administrative work in diverse legal activities associated with CPRA Board and CPRA. The incumbent also facilitates the overall legal program including such areas as integrated coastal restoration and protection, flood control, levees, land rights, water resources development, state and public lands, public records, coastal zone and barrier island management and protection, Coastal Trust Fund administration, public construction contracts, etc. Legal issues often require consultation and coordination with other departments, as well as local, state, federal agencies, NGO’s and/or private entities.

Responsibilities:

  • Supervise and direct internal legal staff and outside counsel

  • Handles legal issues related to public bid and procurement law

  • Reviews and manages public bid and procurement contracts for CPRA

  • Acts as independent legal counsel for Outcome Based Performance Contracting (OBPC) and Construction Manager at Risk (CMAR) project delivery methods

  • Represents CPRA-Board and CPRA in legal matters with various government and legal entities

  • Coordinates with the Legal Department of Justice, Department of Natural Resources, U.S. Army Corps of Engineers, and other authorities

  • Supervises staff attorney for land rights and manages complex land rights issues

  • Prepares legal opinions on CPRA’s jurisdiction matters

  • Prepares, reviews, and drafts new legislation related to CPRA

  • Testifies before legislative committees and keeps CPRA officials informed

  • Provides legal advice on CPRA decision affecting various agencies and programs

  • Advises on commenting to the U.S. Army Corps of Engineers in its permit programs

  • Consults with CPRA personnel on legal matters like subpoenas and court orders

    The maximum salary for the Attorney-General Counsel 2 position is $147,555 annually.

Minimum Qualifications

MINIMUM QUALIFICATIONS:

Possession of a license to practice law in the state of Louisiana, plus five years of experience as a practicing attorney.

Differs from Workers' Compensation Judge and Attorney Supervisor by responsibility for serving as the principal assistant to the Attorney--General Counsel 3 (Workers' Compensation Chief Judge).

Differs from Attorney--General Counsel 3 by subordinate relationship.

Differs from Attorney--Deputy General Counsel 1 by serving as the primary assistant to an Attorney--General Counsel 3.

Examples of Work

Assists the chief legal counsel of one of the largest legal divisions in administrative and/or legal matters.

Represents the department in more complex and important litigation before trial and appellate courts and administrative tribunals.

Drafts and reviews the drafting of new legislation. May testify on the same before legislative committees and other tribunals.

Prepares and reviews the preparation and negotiation of departmental contracts, requests for proposal and other legal documents.

Plans, organizes, directs and controls work activities of the division as assigned by the General Counsel.

Develops or assists in the development of budget recommendations for the division.

Coordinates the selection and assignment of subordinate staff, identifies staff development needs and assures that training is obtained.

Prepares and may review the preparation of briefs and other activities incidental to litigation and court work.

Assists the Workers' Compensation Chief Judge with administration of the Hearings Division of the Office of Workers' Compensation, and with supervision of the Workers' Compensation Judges, Mediators, and staff.

Assists the Workers' Compensation Chief Judge with the development, implementation and monitoring of programs, policies and procedures of the Hearings Division.

Assists in the preparation of manuals governing the procedures and operation of the offices.

Represents the agency at meetings and conferences with federal agencies, other state agencies, political subdivisions, advisory groups and other employer/employee organizations in the absence of the Workers' Compensation Chief Judge.

Speaks at seminars and conferences on Workers' Compensation issues as needed. Assists the Workers' Compensation Chief Judge in maintaining a record of all written decisions of the Workers' Compensation Judges and in compiling and disseminating them to the district offices.

Assists the Workers' Compensation Chief Judge in reviewing the quality and correctness of decisions rendered by the Workers' Compensation Judges and makes recommendations concerning training as necessary.

Acts as a legal resource to the public by replying to complex inquiries from employers, employees, legislators and other public entities concerning official procedures, interpretations and policies of the Office of Workers' Compensation.

Drafts and makes recommendations concerning new legislation relating to the programs within the Hearings Division, reviews and recommends changes to the Hearing Officer Rules and Regulations as necessary.

Conducts complex legal research and renders legal opinions for use by the Workers' Compensation Chief Judge and district offices.

Plans, organizes, directs and controls work activities of the Hearings Division as assigned by the Workers' Compensation Chief Judge.

Travels to district offices around the state in order to accomplish the above mentioned duties.

Carries out such other general responsibilities and special projects as may be delegated by the Workers' Compensation Chief Judge.
